Punjab informs LHC: convicted civilians cannot claim rights
Punjab told the Lahore High Court that Barrister Hassaan Khan Niazi, sentenced after the May 9 violence, cannot seek constitutional protection as a convicted prisoner.
Punjab told the Lahore High Court that a civilian convicted of offences against the state cannot claim fundamental rights protection.
The stance came in a report seeking dismissal of Barrister Hassaan Khan Niazi’s petition against his army handover and military trial.
Niazi was sentenced to 10 years’ rigorous imprisonment by a field general court martial after the May 9, 2023 Jinnah House incident.
The defence ministry said the petition is barred by constitutional limits on high-court review of armed-forces proceedings.
Officials said he already has an Army Act appeal pending and cannot pursue the same legal question in two forums.
