FCC stays PHC orders that limited 3-MPO arrests in KP
A two-member bench led by Chief Justice Aminuddin Khan stayed Peshawar High Court orders that had blocked preventive arrests under Section 3 of the Maintenance of Public Order Ordinance in Khyber Pakhtunkhwa.
The Federal Constitutional Court restrained the Peshawar High Court from hearing cases on Section 3-MPO arrests in Khyber Pakhtunkhwa.
The stay follows a KP government appeal against PHC orders that had blocked such arrests and ordered the release of 28 PTI workers.
The KP advocate general argued the high court lacked jurisdiction under Articles 199 and 245 of the Constitution.
The FCC issued notices to the parties, suspended the challenged PHC orders, and adjourned the matter indefinitely.
