FCC upholds PHC order on KP constable with Rs500 fine

An FCC court ruling lets a Dir Lower candidate fined Rs500 for a minor fire-related offence still be considered for a KP police constable post after the court rejected a lifelong ban.

The Federal Constitutional Court held that a trivial or less harmful offence should not permanently block induction into government service.

The bench upheld a Peshawar High Court order directing Khyber Pakhtunkhwa authorities to consider Hanifullah for a police constable post.

Hanifullah had been convicted under Sections 285 and 286 PPC after FIR No.269 of 22 April 2018 at Talash, Dir Lower, and fined Rs500 on a confession.

The court said the fine was a minor penalty, not a heinous crime or moral turpitude, and the record did not show him to be a habitual offender.

Police recruitment still requires good character under Rule 12.14 of the Police Rules, 1934, but lasting bans must fit the offence.
