FCCP: lease or long possession does not own govt land
Under government land ownership rules, the Federal Constitutional Court held that a temporary lease, long possession or price deposit does not create title to prohibited-zone farmland in Pakpattan.
The Federal Constitutional Court of Pakistan (FCCP) held that a temporary cultivation lease, long possession or depositing the price does not create ownership of government land in a prohibited zone.
A two-judge bench set aside a Lahore High Court judgment on about 49 acres, five kanals and 13 marlas of agricultural land in Pakpattan, Punjab.
The court restored a Punjab Board of Revenue order of 24 August 2011 that had rejected the claimants’ ownership claim.
The land was leased for temporary cultivation from Kharif 1968 to Rabi 1978; a 1979 ownership claim was refused because the land was in a prohibited zone.
