FCCP land allotment ruling bars reopening final decisions

The FCCP land allotment ruling dismissed Anwari's plea over a Bhakkar girls' school site and said an executing court cannot amend a final decree.

The Federal Constitutional Court of Pakistan ruled that final land distribution and allotment decisions by revenue and consolidation authorities cannot be reopened merely over land identification or khasra-number disputes.

A two-member bench of Justice Syed Arshad Hussain Shah and Justice Rozi Khan Barrech dismissed petitioner Anwari's plea and declined leave to appeal.

Anwari said a girls' school in Shah Alam Dagar, Kallur Kot tehsil, Bhakkar, was built on her land instead of three kanals and 16 marlas donated by Shera Khan.

The court said consolidation had fixed her rights without cutting her overall holding, and that final decisions may reopen only for fraud, mistake or lack of jurisdiction.

It also held that an executing court cannot amend a final decree or go beyond its scope, and that the same dispute cannot be raised again through new proceedings.
