SC medical negligence ruling ends twin-birth death case
Justice Ishtiaq Ibrahim’s six-page verdict says a patient’s death during treatment is not itself criminal negligence, and leaves lower-court decisions undisturbed.
The Supreme Court dismissed a petition seeking criminal proceedings against doctors after a woman’s death during twin delivery in Islamabad.
Justice Ishtiaq Ibrahim ruled that death during medical treatment is not, by itself, proof of criminal negligence.
The verdict said consent for the operation was obtained and there was no material showing intent, bad faith, or misuse of anaesthesia.
The Pakistan Medical and Dental Council had withdrawn its preliminary medical-negligence proceedings.
The court found no basis to disturb the subordinate court and Islamabad High Court decisions.
