Supreme Court receiver ruling sets higher bar for Nazirs
A two-judge bench set aside a Sindh High Court order naming a Nazir as receiver of Kohinoor Petrol Pump in Hyderabad, saying stronger grounds than an injunction are required.
The Supreme Court said appointing a receiver over disputed property is an extraordinary step that needs proof of imminent risk of loss, damage or unlawful transfer.
A party’s request alone is not enough; stronger grounds are required than for a temporary injunction.
The case involved dealership and inheritance shares in Kohinoor Petrol Pump in Hyderabad.
The Sindh High Court had appointed the trial court’s Nazir as receiver on 20 October 2025; the Supreme Court found that went beyond the issue before the court.
Justice Muhammad Ali Mazhar and Justice Irfan Saadat Khan heard the matter; the judgment was authored by Justice Mazhar.
