Supreme Court sets aside an ex parte property judgment
The court set aside a property judgment made without a proper hearing and sent the case back. Notice must be served, and each side must have a chance to be heard.
The Supreme Court set aside an ex parte property judgment, the Lahore High Court judgment and related orders.
No ex parte judgment can be passed without proper service of notice and an effective opportunity of hearing, the court said.
The trial court must decide the case afresh and try to conclude within four months of the parties' first appearance.
The parties are directed to appear before the relevant district judge on October 26, 2026.
The court said it had expressed no view on the merits of the underlying dispute.
