The Islamabad High Court has kept in place a stay that stops the Capital Development Authority (CDA) — Islamabad’s civic planning body — from taking coercive action against people who have challenged notices linked to a planned service road near Korang Chowk.

Justice Muhammad Azam Khan consolidated the petitions over alleged encroachments around Korang Chowk and nearby areas. In a one-page written order, he maintained the restraint on the CDA while the cases move forward on a short timetable.

What the court ordered next

The court gave the CDA and other parties two weeks to submit their replies to the petitions. The CDA’s counsel asked for more time to file a power of attorney and paragraph-wise comments, according to the order.

The bench also directed the CDA to complete the necessary proceedings and place a report on the record within the same two-week window. It said the consolidated cases should be listed for hearing again after that period. The hearing has been adjourned for two weeks.

Who filed the petitions and why

Among the petitioners named are Malik Mumtaz and Zardan Begum. They have challenged CDA notices connected with a proposed operation to build a service road in the area. The notices relate to alleged encroachments around Korang Chowk and adjoining localities.

The court had already granted interim relief earlier, stopping the CDA from coercive steps against the petitioners. Friday’s order keeps that protection in place while the authority prepares its formal response and the report the court has sought.

For residents and businesses in the corridor, the immediate legal effect is that the planned service road drive cannot proceed against these petitioners through forceful measures until the court hears the matter again. The CDA remains free to put its case on paper, but it must do so within the two weeks fixed by the bench.
