Muhammad Amir on Tuesday petitioned the Peshawar High Court to trace his brother, KP CM Sohail Afridi, and to have him produced if he is in custody. Dawn, The Express Tribune and Business Recorder reported the filing. Business Recorder says the account of the plea was shared on Afridi's Facebook page. The plea calls Afridi the elected chief minister and also describes him as non-functional. It says he was taken from the Chief Minister's House and is confined with no lawful basis disclosed. These reports give no case number and no judicial order.

What the family alleges

According to the plea, the group that took Afridi away was carrying weapons, and masks hid their faces, while Peshawar's CCPO (Capital City Police Officer, the officer who commands city policing) was on the spot. Amir says both the removal and the confinement afterwards offend the Constitution, ordinary statute and basic rights. He warns that Afridi's life and freedom face a real threat, and that giving the family no word on the place of confinement makes the constitutional injury worse. Four clauses are invoked — Article 4, Article 9, Article 10 and Article 14 — as the legal basis for that rights claim.

What the plea asks the judges to do

Amir wants an early listing, with Afridi found and returned and with the people detaining him required to stand Afridi in front of the judges. He wants Peshawar's CCPO to put on record the full sequence and the guard that was on duty at the residence, plus straight answers on the place of confinement, the identity of the captors, and any legal power they claim. He wants an outside inquiry, the participants named, lawful action where the inquiry supports it, and recordings from cameras, security logs and any other material at the residence preserved before it can disappear. Police, he adds, should file a written narrative of each step already taken to find the chief minister, because waiting could put Afridi's life in danger.

What is not yet confirmed

Dawn says the petition asks the KP inspector general and Peshawar's CCPO to trace Afridi and, if he is in custody, produce him so the court can test the detention under Article 199. Tribune says the plea was filed through counsel Bashir Khan Wazir and puts the alleged seizure at about 2pm on 11 October at the Chief Minister's House. No hearing date or court order is in these reports, and they quote no reply from the CCPO. Afridi's location, and the legal footing of any confinement, are still unconfirmed.

Aasan alfaaz mein

Sohail Afridi ke bhai Muhammad Amir ne mangal ko Peshawar High Court mein darkhwast de di hai. Dawn, Express Tribune aur Business Recorder ne is darkhwast ki khabar di. Wo kehte hain ke 11 October ko taqreeban 2 baje Afridi ko unke sarkari ghar se mask pehne hue hathiyar-bardar log le gaye, aur police ka bara afsar wahan maujood tha. Abhi adalat ka faisla ya police ka jawab in khabaron mein nahi hai.
