If you need to apply for a police character certificate online or through a police station, the core question after this ruling is simple: can an old FIR still appear once a court has finally acquitted you? The Islamabad High Court (IHC) has said no. Justice Ayyaz Shaukat held that police must not mention criminal cases on character certificates issued to people who have been finally acquitted, and he directed the Islamabad Inspector General of Police (IGP) to put a clear procedure in place so that does not happen.
What the court decided
The judgment came on a petition by a citizen who wanted an FIR registered at Shalimar Police Station removed from his police character certificate. The court found no legal basis for listing cases that ended in final acquittal. Keeping those references, it said, could unfairly make an acquitted person look like a criminal.
The bench also struck down the certificate already issued to the petitioner. That document had described him as discharged during investigation, even though the court’s final decision was acquittal. Calling an acquitted person merely “discharged,” the judgment said, weakened their legal status.
What changes for certificates citizens receive
For anyone who must apply for a police character certificate online or in person—especially people travelling abroad—the practical effect is about what the paper or file shows. Police may still hold details of past cases in their own internal records. They may not put those finally acquitted matters on the character certificate given to the citizen.
The court stressed that people should not have to keep returning to court to obtain rights the law already gives them. Once a final acquittal is on record, the certificate issued for ordinary use should not keep advertising the old FIR.
Constitutional points the court cited
Justice Shaukat linked the practice of leaving an acquitted FIR on a character certificate to violations of constitutional protections under Articles 4, 9, 14 and 15 of the Constitution. In plain terms, the court treated a clean final acquittal as something the state must respect when it issues an official character document to a citizen.
The order binds the Islamabad police leadership to design a workable process so that certificates match the court’s final outcome, not an outdated or softer label from the investigation stage. How stations implement that procedure will matter for every fresh request to apply for a police character certificate online or at the counter.
Aasan alfaaz mein
Islamabad High Court ne kaha hai ke agar kisi ko court ne bilkul bari kar diya ho, to us ka purana FIR police character certificate par nahi likha jana chahiye. Police apne andaruni record mein yeh maloomat rakh sakti hai, lekin citizen ko milne wale certificate par nahi. Yeh faisla un logon ke liye zaroori hai jo mulk ke bahar jaate waqt character certificate lete hain. Ab Islamabad police ko aisa tareeqa banana hoga ke bari hone ke baad FIR certificate se hat jaye.
